Terms of Service

1. AI-Only Content Policy

FreeMusicLab.ai ("the Platform", "we", "us") accepts ONLY AI-generated music and sound effects. Content produced by human performance, traditional recording, sampling of copyrighted works, or any non-AI methods is strictly prohibited. We reserve the right to remove any content that does not meet this requirement without notice. Repeat offenders may have their accounts terminated.

2. Upload Liability

By uploading content, you ("User") represent and warrant that you are solely responsible for:

• Ensuring your AI-generated content does not infringe existing copyrights, trademarks, or intellectual property rights.
• Complying with the terms of service of the AI tool providers used to generate your content (including but not limited to Google Lyria, Suno, Udio, Stable Audio, and similar services).
• Not uploading content designed to mimic specific known artists, vocal likenesses, copyrighted melodies, or protected works.
• Any legal claims, damages, or liabilities arising from your uploads.

FreeMusicLab.ai acts as a hosting intermediary and disclaims all liability for user-submitted content.

3. License Grant

By uploading content to FreeMusicLab.ai, you grant us a worldwide, non-exclusive, royalty-free, perpetual license to host, distribute, reproduce, publicly display, and sublicense your content to downloaders under our standard credit-attribution terms. You retain ownership of your content, but this license allows the Platform to operate its distribution model.

4. Credit Attribution Requirement

Users who download content from FreeMusicLab.ai are required to credit the original uploader when using the content. Standard credit format: "Music by [Uploader Name] via FreeMusicLab.ai". Failure to credit may result in license termination for the downloader.

5. Premium License (No-Credit Option)

Content may be licensed without the credit-attribution requirement through paid premium options where available. Premium licenses are granted on a per-track basis and are subject to separate payment terms. Premium license revenue may be shared with original uploaders at the Platform's discretion.

6. Google Signup Consent

Signing up for FreeMusicLab.ai via Google OAuth, or by any other method, constitutes your full acceptance of these Terms of Service and our Privacy Policy. If you do not agree, do not create an account.

7. Content Removal Rights

We reserve the right to remove any content at our sole discretion, including but not limited to content that: (a) is not AI-generated, (b) infringes third-party rights, (c) violates applicable laws, (d) contains hateful, illegal, or harmful material, or (e) otherwise violates these Terms. We are not required to provide notice or justification for removal.

8. No Warranty

ALL CONTENT ON FREEMUSICLAB.AI IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FREEMUSICLAB.AI, ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM OR ANY CONTENT OBTAINED THROUGH IT. OUR TOTAL LIABILITY SHALL NOT EXCEED USD $100 OR THE AMOUNT YOU PAID TO US IN THE PAST 12 MONTHS, WHICHEVER IS LESS.

10. Changes to These Terms

We may update these Terms of Service at any time. Material changes will be communicated via email to registered users or a prominent notice on the Platform. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Korea, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Platform shall be resolved in the courts of Seoul, South Korea.

1. AI 전용 콘텐츠 정책

FreeMusicLab.ai("본 플랫폼")은 AI로 생성된 음악 및 사운드 이펙트만을 허용합니다. 사람의 실연, 전통적인 녹음, 저작권이 있는 작품의 샘플링, 기타 비AI 방식으로 제작된 콘텐츠는 엄격히 금지됩니다. 요건을 충족하지 않는 콘텐츠는 사전 통보 없이 삭제될 수 있으며, 반복 위반자는 계정이 정지될 수 있습니다.

2. 업로드 책임

콘텐츠를 업로드함으로써 사용자는 다음 사항에 대한 단독 책임을 집니다:

• AI 생성 콘텐츠가 기존 저작권, 상표권, 지식재산권을 침해하지 않도록 보장
• 사용한 AI 도구 제공자(Google Lyria, Suno, Udio 등)의 이용약관 준수
• 특정 유명 아티스트, 보컬 유사성, 저작권 있는 멜로디를 모방하지 않을 것
• 업로드로 인해 발생하는 모든 법적 청구 및 손해

3. 라이선스 부여

콘텐츠를 업로드함으로써 사용자는 FreeMusicLab.ai에 전 세계적, 비독점적, 무료, 영구적인 라이선스를 부여하여, 크레딧 표기 조건 하에 콘텐츠를 호스팅, 배포, 복제, 공개, 재라이선스할 수 있도록 합니다. 사용자는 콘텐츠에 대한 소유권을 유지합니다.

4. 크레딧 표기 의무

콘텐츠를 다운로드하는 사용자는 원 업로더를 반드시 크레딧으로 표기해야 합니다. 표준 형식: "Music by [업로더명] via FreeMusicLab.ai".

5. 프리미엄 라이선스

유료 프리미엄 옵션을 통해 크레딧 표기 의무 없이 콘텐츠를 라이선스할 수 있습니다. 프리미엄 라이선스 수익은 본 플랫폼의 재량에 따라 원 업로더와 분배될 수 있습니다.

6. Google 가입 동의

Google OAuth 등을 통해 FreeMusicLab.ai에 가입하는 것은 본 이용약관 및 개인정보처리방침 전체에 대한 동의로 간주됩니다.

7. 콘텐츠 삭제 권한

본 플랫폼은 단독 재량으로 콘텐츠를 삭제할 권리를 보유합니다. 여기에는 비AI 콘텐츠, 제3자 권리 침해, 법률 위반, 혐오/불법/유해 콘텐츠 등이 포함되며, 삭제 시 사전 통보나 사유 제공 의무는 없습니다.

8. 무보증

본 플랫폼의 모든 콘텐츠는 상품성, 특정 목적 적합성, 비침해성, 정확성에 대한 명시적 또는 묵시적 보증 없이 "있는 그대로" 제공됩니다.

9. 책임 제한

법률이 허용하는 최대 범위 내에서 FreeMusicLab.ai는 플랫폼 사용과 관련된 간접적, 부수적, 결과적, 특별, 징벌적 손해에 대해 책임지지 않습니다. 총 책임액은 100 USD 또는 지난 12개월 동안 지불한 금액 중 적은 금액을 초과하지 않습니다.

10. 약관 변경

본 약관은 언제든지 변경될 수 있으며, 중요한 변경사항은 이메일 또는 플랫폼 공지로 안내됩니다. 변경 이후 계속 이용하는 것은 변경된 약관에 대한 동의로 간주됩니다.

11. 준거법

본 약관은 대한민국 법률에 따라 해석되며, 분쟁은 서울중앙지방법원을 관할 법원으로 합니다.
